RE: Southwestern Company and Wisconsin SB-80 Legislation

 

Again the Southwestern Company is trying to destroy a piece of Wisconsin legislation that was designed specifically to protect Wisconsin kids and homeowners from crimes associated with the traveling door to door sales industry. They bring attorneys from the Direct Selling Association, high priced Lobbyists, recruiters, parents of kids that have worked for Southwestern and the sales agents themselves all to blabber on about what a wonderful company they have and how the SB-80 will affect their so called “business model.” But when Kristen Rae Spicer testified in front of the Senate Committee on April 10, 2007 that she had been raped by a fellow Southwestern sales agent the loud and boastful trumpet of Southwestern fell silent.

 

In reality the SB-80 legislation is not about the Southwestern Company, it is about the safety and well being of Wisconsin kids and homeowners. It is about putting an end to the “independent contractor” vs. “employee” debate. And it is about giving rights to sales agents who currently have no rights and are treated as slaves and indentured servants.

 

When Southwestern Company complains that this legislation will hurt their “business model” what they are really saying is that it will hurt their pocketbook. Currently the sales agents who work for Southwestern are treated as “independent contractors” and as such have no minimum wage, no health insurance, no workers compensation, and no company benefits whatsoever. This working status puts the Southwestern sales agents into the exact same category as the traveling magazine sales agents who are treated as indentured servants and slaves. We believe that giving a human being rights and the ability to make a minimum wage far outweighs the status of indentured servant. We also believe that the safety and well being of Wisconsin kids and homeowners is far more important than the Southwestern Companies pocketbook.

Recently I was asked if I thought that Southwestern Company was a scam. Here is my response:

 

In my opinion - worse than being a scam the Southwestern Company is exploiting young college kids. Working them 80 hours a week while controlling their every move. This mode of labor is currently known as slavery or indentured servitude. Being independent contractors the kids have absolutely no rights, no minimum wage, no health insurance. The independent contractor model affords Southwestern two very important advantages. First Southwestern pays nothing to their hard working indentured servants while pulling in the profits from their labor and second if one of the kids breaks the law Southwestern simply points out that the kid does not actually work for Southwestern because he/she is an independent contractor. We call this "business model" : The dirty business of sales by exploitation without legal entanglement.
