Dear Assemblyman Moulton:

 

            I am writing to you today requesting authorizing from you to hold a public hearing on Wisconsin Senate Bill SB-80 – Traveling Sales Crew Protection Act.  Legally, this legislation represents potential important protections for citizens of our state.

 

            Several years ago, I got involved with an accident case stemming from a motor vehicle accident, which happened on March 25, 1999.  This tragic accident was a one car van rollover accident which took the lives of six young people and severally injured several others.  The young people who were the victims of this accident were members of a traveling sales crew who had been recruited at various parts of the country, including several from Wisconsin.  One of my clients was the Estate of Malinda L. Turvy by her father, Philip Ellenbecker.  I had filed suit on behalf of Malinda’s estate against the owners of the company who had assembled this sales crew, as well as the magazine distribution company for whom the sales crew was selling. 

 

            One of our frustrations in moving forward with this litigation is that there were essentially no laws or regulations on our books in anyway regulating the traveling sales crew industry.  As a result, we have no effective check against itinerant traveling crews from coming into our state and praying on our young people.  Unfortunately, the case that I was involved in was not an isolated incident.  Tragically, these events continue to occur.

 

            I, again, ask that you please authorize and schedule a public hearing on this important bill. This is not a matter of politics.  This is a bill that will finally impose some much needed regulations on this often dangerous industry.
